A Capriciano gift card is one of the most generous things to give a wine‑and‑table lover. These Gift Card Terms (the “Terms”) govern the purchase, possession, and redemption of gift cards issued by Capriciano Restaurant Group LLC d/b/a Capriciano Osteria (“Capriciano,” “we,” “us,” or “our”). By purchasing or using a Capriciano gift card you agree to these Terms.
1. Definitions
- “Gift Card” means any physical or electronic gift card or gift certificate issued by Capriciano that the purchaser has paid value for in U.S. dollars at the time of purchase.
- “Promotional Card” means any physical or electronic card or certificate issued by Capriciano at no charge for promotional, marketing, customer‑service‑recovery, gift‑with‑purchase, contest‑prize, or charitable‑donation purposes. Promotional Cards are governed by separate terms as described in Section 8.
- “Balance” means the unspent value remaining on a Gift Card or Promotional Card.
2. Purchase
Gift Cards are available for purchase in person at the Restaurant at 505 Mendocino Avenue, Santa Rosa, California 95401, and (where the function is available) online through our website. Cards may be issued in any denomination set out at the point of sale, in U.S. dollars only. $1,000
Purchases are processed by our payment processor and are subject to that processor’s verification and fraud‑prevention practices. We reserve the right to decline a Gift Card purchase that we reasonably believe to be fraudulent.
3. Redemption
Gift Cards may be redeemed at the Restaurant toward:
- Food and beverage at the table;
- Takeaway orders placed at the Restaurant;
- Service charges, the twenty percent (20%) automatic gratuity that applies to parties of five (5) or more, and discretionary gratuity;
- Private event deposits and final invoices, subject to the terms of the event contract; and
- Retail items where offered for sale.
Gift Cards may not be redeemed for the purchase of other gift cards, for cash advances, or for tip‑outs to staff outside the bill. Multiple Gift Cards may be used in a single transaction. Unused Balance remains on the Gift Card for future use.
4. No Expiration and No Service or Dormancy Fees
In accordance with Cal. Civ. Code §1749.5(a)(1), Capriciano Gift Cards do not expire. In accordance with Cal. Civ. Code §1749.5(b)(1), we do not impose any service fee, dormancy fee, inactivity fee, or maintenance fee on Gift Cards. Your Gift Card retains its full purchase value indefinitely.
5. Cash Redemption of Small Balances
In accordance with Cal. Civ. Code §1749.5(b)(2), if the remaining Balance on a Gift Card is less than ten U.S. dollars (US$10), you may request that we redeem the Balance for cash at the Restaurant. Balances of ten dollars or more are not redeemable for cash and remain on the Gift Card for future use.
6. Lost, Stolen, or Damaged Cards
Treat your Gift Card like cash. Lost, stolen, or damaged cards are generally not replaceable, and Capriciano is not responsible for unauthorized use of a Gift Card not in your possession. If you believe your Gift Card has been lost or stolen, please contact us promptly at hi@capriciano.com or (707) 800‑7904. Where we are able to identify the original purchase and the unused Balance, we may — at our sole discretion and as a one‑time accommodation — cancel the original card and issue a replacement equal to the remaining Balance.
7. Balance Inquiry and Disputes
To check the Balance on a Gift Card, please contact us at the Restaurant or call (707) 800‑7904. If you believe the Balance shown is incorrect, please contact us within thirty (30) days of the disputed transaction. We will investigate in good faith and respond within fifteen (15) business days.
8. Promotional Cards
Promotional Cards are not Gift Cards within the meaning of Cal. Civ. Code §1749.5(d). The cash‑back, no‑expiration, and no‑fee rules in Sections 4 and 5 do not apply to Promotional Cards. Each Promotional Card states on its face its expiration date, any restrictions, and the value of the card. To the extent a Promotional Card does not state restrictions, the following default restrictions apply: the card expires twelve (12) months after the date of issue; the card is non‑transferable; the card has no cash value and is not redeemable for cash; the card may not be used to purchase another gift card; and the card may be combined with other offers only as we expressly permit at the time of redemption.
9. Tax Treatment
Consistent with California State Board of Equalization guidance, the purchase of a Gift Card is not a taxable transaction. Applicable sales tax is calculated and collected when the Gift Card is redeemed for food, beverage, or other taxable items at the Restaurant.
10. Resale and Transfer
Gift Cards are personal to the bearer and may be given as a gift. Resale of a Gift Card on a secondary market, through an online auction or marketplace, or for any commercial purpose without our prior written consent is prohibited. Cards reasonably believed to have been obtained in violation of this Section, by fraud, or in violation of law may be cancelled without refund.
11. Successor in Interest
If Capriciano transfers, sells, or assigns its restaurant operations to a successor entity, outstanding Gift Cards will continue to be honored by the successor at the same Restaurant location to the fullest extent permitted by law and consistent with Cal. Civ. Code §1749.6. If the Restaurant permanently ceases operations, our policy for honoring outstanding Gift Cards will be posted at the same URL as these Terms.
12. Privacy
Information collected in connection with a Gift Card purchase, including the purchaser’s name, billing address, email address (for delivery of an e‑Gift Card), and payment data handled by our processor, is treated in accordance with our Privacy Policy. We do not sell or share personal information for cross‑context behavioral advertising.
13. Changes to These Terms
We may revise these Terms from time to time. The revised version will be posted at this URL with an updated “Effective Date.” Updates apply prospectively and will not reduce the value or the rights associated with a previously purchased Gift Card in any manner prohibited by law.
14. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict‑of‑law principles. Any dispute arising out of or relating to a Gift Card or these Terms shall be brought exclusively in the state or federal courts located in Sonoma County, California.
